These Terms and Conditions (the “Terms”) govern access to and use of the Santelle website available at www.santellehealth.com (the “Website”), the Santelle mobile application (the “App”), and the purchase and use of Santelle test kits and related digital services (together, the “Services”).
The Services are operated by Santelle SARL, a company incorporated under the laws of Switzerland, with its registered office at 5B Route de Pressy, 1243 Vandoeuvres, Switzerland (“Santelle”, “we”, “our”, “us”).

By accessing or using the Website or the App, or by purchasing a Santelle test kit, you agree to be legally bound by these Terms. If you do not accept these Terms, you must not use the Services.
1. Eligibility
1.1 The Services are intended for people aged 16 or over. By using the Services, you confirm that you meet this age requirement.
1.2 If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian to use the Services and to enter into these Terms.
1.3 You must be legally capable of entering into binding contracts in your jurisdiction in order to purchase products or create an account.
1.4 By accepting these Terms, you confirm that you have the legal capacity and authority to enter into a legally binding contract with Santelle under applicable law.
2. Description of the Services
2.1 Santelle offers physical at-home vaginal health self-test kits (the “TestKits”) together with an associated App that provides:
Display of test results (including positive/negative indicators);
Educational information explaining what those results generally mean;
General, non-personalised information about the pathways or steps typically associated with those results.
2.2 The App is strictly informational and educational. It does not provide medical advice, diagnosis, treatment or prescriptions. Any information provided by the App should be used alongside a medical consultation and medical advice, not as a replacement for the opinion of a qualified healthcare professional.
2.3 The Services do not constitute a medical device or an in vitro diagnostic device, and do not replace a professional medical consultation.
3. Account creation and access
3.1 When you purchase a TestKit, a user account is created automatically to give you access to the App.
3.2 You are responsible for keeping your account credentials confidential and for all activity carried out under your account. You will, however, need to confirm your acceptance of these terms and conditions before you can use the App.
3.3 Santelle reserves the right to suspend or terminate accounts used in breach of these Terms.
4. Access to the App
4.1 The Santelle app is free. Downloading and using it requires no subscription and no additional payment. The App is used with Santelle TestKits.
4.2 Santelle may change the features, content or functionality of the App over time. No consent is required for Santelle to improve, modify, change or update the App and any of its features.
5. Orders and payment
5.1 Purchases are made through the Website using Shopify Payments.
5.2 Prices are displayed in the local currency applicable to the buyer’s location and may include applicable taxes.
5.3 Santelle reserves the right to refuse or cancel orders at its discretion.
6. Delivery
6.1 TestKits are shipped from Switzerland to Switzerland, the European Union and the United Kingdom.
6.2 Delivery times are given as an indication only and are not guaranteed.
7. Returns and refunds
7.1 In accordance with applicable consumer protection law, consumers in the European Union and the United Kingdom may have a 14-day right of withdrawal from the date of receipt.
7.2 For hygiene and safety reasons, sealed TestKits cannot be returned once opened or unsealed.
7.3 No refund will be given for:
Opened or used TestKits;
Digital services once access to the App has been granted or the content delivered.
7.4 Unopened, sealed TestKits may be returned in accordance with Santelle’s return instructions.
8. Informational use and disclaimers
8.1 The Services provide general informational and educational content only.
8.2 Any information presented as “typical” pathways, results or actions reflects general educational knowledge and does not take into account your personal medical history, your symptoms or your situation.
8.3 You acknowledge and agree that you must not rely on the Services to make health, medical or treatment decisions.
8.4 Santelle does not guarantee the accuracy, completeness, reliability, timeliness or suitability of any information provided through the Services, including test results or explanatory content.
8.5 Santelle cannot be held liable for any action taken or not taken by you on the basis of information obtained through the Services.
8.6 The Services are not intended for use in an emergency. If you have urgent symptoms or concerns, you must seek professional medical assistance immediately.
9. User data and privacy
9.1 Using the Services involves the processing of personal data and sensitive health data.
9.2 Santelle processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms and is incorporated into them by reference.
9.3 By using the Services, you consent to that processing.
10. Intellectual property
10.1 All content, software, trade marks and elements making up the Services are owned by Santelle or licensed to Santelle.
10.2 You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
11. Prohibited uses
You agree not to:
Misuse the Services;
Attempt to reverse engineer the App;
Use the Services for unlawful purposes;
Compromise the security or integrity of the Services;
Fail to seek the advice of a healthcare professional.
12. Limitation of liability
12.1 To the fullest extent permitted by applicable law, Santelle shall not be liable for indirect, incidental, consequential, special or punitive damages, including but not limited to loss of profits, loss of data, emotional distress, anxiety or health-related consequences.
12.2 Santelle shall not be liable for damages arising from:
Reliance on informational content;
Incorrect interpretation of test results;
Delays, interruptions or unavailability of the Services;
Events beyond Santelle’s reasonable control.
12.3 Santelle’s total aggregate liability arising out of or in connection with the Services shall not exceed the amount you paid for the TestKit giving rise to the claim.
12.4 Nothing in these Terms limits any liability that cannot be excluded under applicable law, including mandatory consumer protection rights.
13. Indemnity
13.1 You agree to indemnify and hold harmless Santelle, its officers, directors, employees and partners against any claim, damage, loss, liability, cost or expense arising from:
Your misuse of the Services;
Your breach of these Terms;
Your breach of applicable law or of third-party rights.
14. Modification or discontinuation of the Services
14.1 Santelle may modify, suspend or discontinue the Services at any time, for any reason, with or without cause.
14.2 Where reasonably possible, Santelle will give notice of material changes, but is not required to give written advance notice.
15. Governing law and jurisdiction
15.1 These Terms are governed by Swiss law.
15.2 The courts of Geneva, Switzerland, have exclusive jurisdiction.
16. Third-party services
16.1 The Services may rely on third-party platforms or service providers, including payment processors and hosting providers.
16.2 Santelle is not responsible for the availability or performance of these third parties, or for their acts or omissions.
17. Force majeure
17.1 Santelle shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, strikes, supply chain disruption, government action or technical failures.
18. Miscellaneous
18.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.2 Santelle may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
